Definition of a Texas Home Health Care Agency

The State of Texas labels a Home Health Care Agency as a Home Health Service, or - sometimes - a home and community support services agency (HCSS). For the sake of brevity, SeniorResourcesandNews.com will refer to Texas Home Health Care Agencies as Home Health Services. In the State of Texas, a Home Health Service is an entity which provides one or more services required by individuals in their places of residence. These services include:
  • Skilled Nursing - including blood pressure montioring and diabetes treatment
  • Physical, Occupational, Respiratory or Speech Therapies
  • Intravenous Therapy
  • Medical Social Worker Services
  • Dialysis
  • Furnishing of Durable Medical Equipment (DME) and supplies
  • Nutritional Counseling
  • Services provided by non-licensed personnel (such as Personal Care Attendants) under the direction and supervision of a licensed health professional
Licensing Requirements for a Texas Home Health Care Agency

Before the State of Texas grants a license to an applicant for a Home Health Care Agency, the Department of Aging and Disability Services (DADS) reviews both the background and
qualifications of:
  • the applicant (who must be at least 18 years of age)
  • a controlling person of the applicant
  • a person with a declarable interest in the agency
  • an affiliate of the applicant
  • the administrator and alternate administrator
  • the chief financial officer
A Home Health Care Agency must have a Texas address; separate Texas locations require a separate, individual license for each location.

Required Management Personnel Structure and Educational Requirements

A Texas Home Health Care Agency must have a designated administrator and alternate administrator as well as a designated supervising nurse and alternate supervising nurse.*
Administrators and alternate administrators of Texas Home Health Care Agencies are required to read, write and comprehend English, and must either:
• be a licensed physician, registered nurse, licensed social worker, licensed therapist or licensed nursing home administrator with at least one year of management or supervisory experience in a health-related setting
-or-
• have a high school diploma or general equivalency (GED) with at least two years of management or supervisory experience in a health-related setting

In their first 12 months of designation as administrators or alternate administrators of Texas Home Health Care Agencies, both must complete up to 48 clock hours of educational training focused on a variety of topics pertaining to the administration of home health services. Administrators and alternate administrators must also complete mandatory continuing education classes within the first 12 months of tenure.

Background Checks for Staff

Texas Home Health Care Agencies are required to conduct background checks on all unlicensed personnel (such as Personal Care Attendants) whose duties involve face-to-face client contact. By definition, licensed staff members have already been screened for criminal background offenses as a pre-condition to being awarded their state licenses; the Home Health Care Agency is not required to conduct a secondary background check on their licensed professional staff members.

*Texas Home Health Care Agencies are not required to employ supervising nurses if the agency services are solely in the form of providing physical, occupational, speech, respiratory therapies; and/or medical social services; and/or nutritional counseling; and/or personal care services using only non-licensed personal care attendants. All of the aforementioned services may be supervised by a qualified and applicable licensed professional.
