Definition of a Texas In-Home Non-Medical Care Agency

In-Home, Non-Medical Care Agencies in the State of Texas are regulated by the same statutes which apply to all other home health care services. All Texas Home Health Care Agencies may provide clients non-medical services if that category is part of their approved licensure. Some Texas Home Health Care Agencies are licensed only for non-medical care services. Explained below are a number of provisions laid down in State of Texas
statutes exclusively pertaining to Personal Care Agencies. In Texas, a Personal Care Agency is defined as an agency which provides services not constituting the practice of professional nursing. These services may be health-related and if so, must be assigned by and conducted under the supervision of a registered nurse; or - services can fall under the category of Personal Care (such as Assistance with ADL's; assisting with self-administered medications; transfer or ambulation assistance; light housekeeping; meal preparation; etc.) and do not require supervision by a registered nurse or other licensed health professional.

Personal Care Service Administrator Requirements

Administrators of Texas Personal Care Agencies must meet at least one of the following conditions:
  • have a high school diploma or a GED with at least one year of experience or training in caring for individuals with functional disabilities
  • have completed two years of full-time study at an accredited college or university in a health-related field
  • be a licensed physician, registered nurse, licensed social worker, licensed therapist or licensed nursing home administrator with at least one year of management or supervisory experience in a health-related setting
  • have a high school diploma or general equivalency degree (GED) with at least two years of management or supervisory experience in a health-related setting
Personal Care Services

Services provided by Texas Personal Care Agencies include: bathing • dressing • grooming • feeding • exercising • toileting • positioning • medication reminders • routine hair and skin care • transfer and ambulation • light housekeeping • meal preparation • errands, transportation and appointment escort • companionship • etc.

Background Checks and Types of Personal Care Agency Staff

Background Checks: All personal care agency owners and administrators, personal care attendants, home health aides or home health medication aides employed by Texas Personal Care Agencies must submit to a criminal background check before any face-to-face client contact.

Personal Care Attendant: Personal Care Attendants are non-professional and unlicensed caregivers only authorized to provide non-medical services to clients in their places of residence; registered nurse supervision is not required for the deployment of a Personal Care Attendant

Home Health Aide: Home Health Aides may also dispense the full range of non-medical services an agency offers. The Home Health Aide classification is an odd catch-all in State of Texas statutes; there is no formal certification for the title, although it is stipulated that to earn a Home Health Aide status, a person must successfully complete 75 hours of study in various health-related subjects and be evaluated by an RN or LVN for core competencies. Authentic Home Health Aides are, for all practical purposes, Certified Nurse Aides (CNA), without the state-issued certificate. (State statutes do make a provision allowing a CNA - with a clean record but whose active status has lapsed - to claim Home Health Aide status.)

Home Health Medication Aide: It is uncommon for a Texas Personal Care Agency to retain a Home Health Medication Aide, but not inconceivable. Home Health Medication Aides hold state-issued permits authorizing them to administer certain classifications of medication and health-related treatments. Home Health Medication Aides are eligible for their permits by completing a state-approved training cirriculum (most often offered as a subset of a qualified nursing program); allowed activities (under direction and supervision of a licensed RN) are: observe, document and report clients' medication side-effects; take and record client vital signs; administer regularly-prescribed medication initially set-up by an RN; apply specifically ordered opthalmalic, otic, nasal, vaginal, topical, and rectal medication; administer oxygen per nasal cannula or a non-sealing face mask only in an emergency. Home Health Medication Aides are not permitted to administer medicine by any injectable route.
