Austin Assisted Living Facilities
State of Texas Assisted Living Facilities are regulated by the Department of Aging and Disability Services (often referred to as DADS). The State of Texas categorizes Assisted Living Facilities into three distinct types:

Types of Texas Assisted Living Facilities

Type A: A facility in which a resident (1.) "must be physically and mentally capable of evacuating the facility without the physical assistance from staff ...". Residents may still meet this requirement if they're non-ambulatory, yet mobile, such as people using wheelchairs or electric scooters and retain the ability to transfer or evacuate themselves in the event of an emergency; (2.) does not require routine
attendance during nighttime sleeping hours; (3.) must be capable of following directions under emergency conditions, and; (4.) must be able to demonstrate to DADS that they can meet evacuation requirements as set down in Texas State Statute §92.62(b).

Type B: A facility in which a resident may (1.) require staff assistance to evacuate; (2.) require attendance during nighttime sleeping hours; (3.) be incapable of following directions under emergency conditions; and (4.) require assistance in transferring to and from a wheelchair (but must not be permanently bedfast).

Type C: Four-bed facilities commonly known as Adult Foster Care Homes (AFCH). This type of assisted living facility is covered in our Texas Adult Foster Care Homes (AFCH) section.

Assisted Living Facility Administrator Requirements

Small Facilities: Managers must possess a high school diplma or certificate of equivalency of graduation (GED).
Large Facilities: Managers must possess either an associate's degree; a bachelor's degree; or a high school diploma/GED and one year of practical experience working in the field of business management or health care industry management.
All Facilities Regardless of Size: Managers must also complete at least one educational course in the management of assisted living facilities. The course must be (minimally) 24 hours in total class-hour length. Twelve (12) hours of annual continuing education is an additional requirement.

Staff Requirements

There is no state mandated staff-to-resident ratio for assisted living facilities. Texas assisted living facilities are required to maintain a staff level sufficient to provide adequate levels of care and assistance to the resident population of the facility.
All Texas assisted living facility staff members, regardless of position, must attend 4 hours of orientation (safety measures, residents' rights, emergency evacuation procedures, etc.) before assuming their duties at the facility.
Attendants must also go through 16 hours of on-the-job supervision and training (providing assistance with ADL's, fall prevention, emergency first aid procedures, etc.) in their first 16 hours on the job.

Criminal Background Checks

Anyone offered a position of employment with or contracted to provide services to a Texas assisted living facility must submit to a criminal background check by the facility. The criminal background checks, which search for records of disqualifying offenses, are obtained from the Texas Department of Public Safety. (Certain medical and paramedical professionals working at an assisted living facility may already have criminal background checks on record with the agency contracting with a Texas ALF or with their professional licensing agency.)

Services and Amenities

Services and amenities at Texas assisted living facilities vary widely. State of Texas statutes stipulate all Type A and Type B assisted living facilities must: provide nutritious meals with full menus planned a week in advance; offer social and/or activity opportunities at leas once per week; and assist with laundry.
