The State of California issues licenses to,
governs, inspects and enforces all aspects of
Home Health Agencies through the California
Department of Public Health (CDPH) and its
Licensing and Certification Division. The State
of California defines a Home Health Agency
as an "organization .... which provides, or
arranges for the provision of, skilled nursing
services, to persons in their temporary or
permanent place of residence."
The State of California defines skilled nursing
services as "services provided by a registered
nurse or licensed vocational nurse." Also
included in the State of California regulatory
code on Home Health Agencies is the
acknowledgement that a licensed Home Health Agency may also provide other therapeutic
services including physical, speech or occupational therapy; medical social services; and home
health aide services.
Qualifications for Home Health Agency Owners and Administrators
All owners and administrators of California Home Health Agencies must meet the following
- Be of good moral character
- Possess and demonstrate the ability to comply with all qualifications set down by the
- File the appropriate applications in full compliance with CDPH requirements
- Submit to the State Department of Health Services an application and fingerprints in
order to submit to a criminal record review
New applicants for a California Home Health Agency license will be issued a six-month
provisional license. A second six-month provisional license may be granted for new agencies
showing a substantial progress towards meeting full State of California qualifications in their first
six months of operation. Once obtaining a standard Home Health Agency license, the agency
will be surveyed by the CDPH no less than once per year in order to assess its adherence to
state licensing standards.
Qualifications for Home Health Agency Staff
All Home Health Agency staff members providing skilled nursing services; therapeutic services;
and medical social services are required to be licensed or certified by the applicable State of
California agency responsible for the governing of their profession.
Personal care services prescribed by a patient's physician or surgeon and part of a Home
Health Agency's plan of treatment are to be dispensed by a Certified Home Health Aide. In
California, a Certified Home Health Aide must successfully complete a state-approved training
program (curriculum including aspects of meal preparation and food storage; cleaning and
sanitation techniques; and personal care procedures and tasks), submit to and pass a criminal
background check and be employed by a licensed Home Health Agency. Certified Home Health
Aides must renew their certifications every 2 years and undergo at least 12 hours of approved
in-service training every year.
Home Health Agencies may provide personal care services to patients which are not part of a
prescribed plan of treatment; these non-prescribed personal care services do not have to be
provided by a Certified Home Health Aide and can be dispensed by a personal care attendant.
